Problem with Data.ChangeLog.Count in 3.5 Scheduler Template

We have customized the e-mail template that goes out and this never seems to be true, even when changes have been made to the issue:

if (Data.ChangeLog.Count > 0)

Any ideas?

The change log will not contain anything if you add a comment but should be populated if you change a status for example.

Is this not the case?
